Agreed.
You mention that you use the iphone as a way to play (with photography). You might be interested in what we are building, a free iphone game. We want to provide a way to take interesting photos in a game framework, with a creativity-on-the-go attitude.

We can't all afford a dSLR, and even if we have one, it's not always in our pocket/bag.
@goPerch or http://signup.goperch.com/ for feedback.

Great post!

Nice breakdown of the issue of ethics and photography.

Technically speaking, shooting in public places that you are not using for marketing/advertising/etc. but for your own artistic use means you do not need to ask for permission at all or have any model releases. That is what public means. For instance, I had to sign a model release when a photographer was shooting an outside of a restaurant and I was eating there because the photo was being used in a magazine that was an advertisement for the restaurant. If the photographer was using the photo as an art piece that he would sell directly as one of his prints then he wouldn't have needed the model release from me because me sitting outside the restaurant was technically a public place and I should expect no right to my privacy.

Every sentient being knows right and wrong and knows that it is wrong to hound people for photos, even in public, and even if it is technically legal to do so. Think of the paparazzi, what they do is technically legal, but they are hounding celebrities in public to get photos to sell to trash mags and newspapers. There is always a gray area, but I think it is obvious when you are stepping over the line from street photography to exploitation.

This is just what I needed to read about now--have just become fascinated with all things camera/iphone related, when I look for online resources, all the "applification" noise can be, well, less than inspirational. I'm with Jody--if I lived nearby, I'd be signing up for a class. Glad to find you and your fotorhetoric-inspirational indeed !
